These Terms and Conditions govern the provision of website design and hosting services by MakeLocal.ie. By engaging our services, you agree to these terms.
1. Services Provided
MakeLocal.ie provides professional website design services for small businesses, including:
- Design and development of a single-page responsive website
- Website hosting on secure European servers (EU-based data centres)
- SSL certificate provision
- Contact form with email notifications
- Basic SEO setup
- Minor content updates as part of ongoing maintenance
2. Pricing & Payment
2.1 Setup Fee
A one-time setup fee of €300 is payable upon agreement to proceed with the website design. This covers all design, development work, and your first year of hosting.
2.2 Annual Renewal
From the second year onwards, an annual fee of €50 covers hosting, SSL certificate, maintenance, and minor updates. This fee is payable annually in advance.
2.3 Domain Registration
Domain registration is not included in the standard pricing but can be arranged at cost. The domain will be registered in your name, and you retain full ownership.
You Own Your Domain
Any domain registered on your behalf is registered in your name with your contact details. You are the legal owner of the domain and can transfer it to any registrar at any time.
3. Website Ownership & Source Code
You Own Your Website
Upon payment of the setup fee, you own the website design and all source code created for your project. This includes HTML, CSS, JavaScript, and any custom graphics created specifically for your site.
3.1 Your Rights
You have the right to:
- Request a copy of all source code at any time
- Modify the code yourself or hire another developer
- Move your website to another hosting provider
- Use the design and code in perpetuity
3.2 What Remains Ours
We retain ownership of:
- Our internal tools and development processes
- Generic code libraries we use across multiple projects
- The MakeLocal.ie brand and marketing materials
4. Cancellation & Site Transfer
4.1 Your Right to Cancel
You may cancel hosting services at any time by providing written notice (email is acceptable). No refunds are provided for partial years of hosting.
4.2 What Happens When You Cancel
Upon cancellation:
- We will provide you with a complete copy of your website source code within 14 days
- We will assist with transferring your domain to another registrar if requested
- Your site will remain live until the end of your paid hosting period
- We will provide reasonable assistance to help you migrate to another hosting provider
No Lock-In
We believe in earning your business, not trapping you. If you decide to leave, we'll make the transition as smooth as possible. Your website files will be provided in standard formats that any web developer can work with.
5. Domain Transfer
5.1 Domain Ownership
If we register a domain on your behalf:
- The domain is registered in your name
- Your contact details are used for registration
- You are the legal owner of the domain
- We act as your technical contact for convenience only
5.2 Transferring Your Domain
To transfer your domain to another registrar:
- Contact us to request the domain authorisation code (EPP code)
- We will provide the code within 5 business days
- Use this code to initiate the transfer with your new registrar
- We will approve the transfer when requested by the new registrar
There is no fee for domain transfers. We will not obstruct or delay legitimate transfer requests.
6. Content & Responsibility
6.1 Your Content
You are responsible for:
- Providing accurate business information
- Ensuring you have rights to any images, logos, or text you provide
- The accuracy of any claims made about your business
- Compliance with relevant Irish and EU laws
6.2 Prohibited Content
We reserve the right to refuse or remove content that:
- Is illegal or promotes illegal activities
- Is defamatory, hateful, or discriminatory
- Infringes on intellectual property rights
- Contains malware or malicious code
7. Liability
7.1 Our Liability
We will make reasonable efforts to keep your website available and secure. However, we cannot guarantee 100% uptime. Our liability is limited to the fees you have paid us in the 12 months preceding any claim.
7.2 Your Liability
You agree to indemnify us against any claims arising from content you provide or your use of the website.
8. Privacy & Data
We collect and process contact form submissions on your behalf. You are the data controller for any personal data collected through your website. We act as a data processor and will:
- Only process data as instructed by you
- Keep data secure using industry-standard practices
- Delete data upon request
- Not share data with third parties without your consent
9. Changes to Terms
We may update these terms from time to time. We will notify you of significant changes by email. Continued use of our services after changes constitutes acceptance of the new terms.
10. Governing Law
These terms are governed by the laws of Ireland. Any disputes will be subject to the exclusive jurisdiction of the Irish courts.
